What is MOA and ICE's 287(g) Program?

ICE’s 287(g) Program, The Illegal Immigration Reform and Immigrant Responsibility Act of 1996, added Section 287(g) to the Immigration and Nationality Act (INA) — authorizing U.S. Immigration and Customs Enforcement (ICE) to delegate to state and local law enforcement officers the authority to perform specified immigration officer functions under the agency’s direction and oversight. The 287(g) Program enhances the safety and security of our nation’s communities by allowing ICE Enforcement and Removal Operations (ERO) to partner with state and local law enforcement agencies to identify and remove incarcerated criminal noncitizens before they are released into the community. If interested in becoming a law enforcement partner under the 287(g) Program, state and local law enforcement agencies may contact ICE at ERO287g@ice.dhs.gov.

  • Gov. Ron DeSantis is in New York to commemorate the Sept. 11 attacks, but he’s also expressing worries about the source of future terror.

  • The Governor added that “9/11 was in part an immigration issue” since a “lot of these guys should not have been in the country — had overstayed visas and whatnot.”

Resolution to both Governor Ron DeSantis and (your county's name) Sheriff (your sheriff's name) to have the later (your sheriff's name) to both sign and fully support the memorandum of agreement (MOA) with U.S. Immigration and Customs Enforcement (ICE) to enforce Section 287(g) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996.

Whereas, the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 added Section 287(g) to the Immigration and Nationality Act (INA) — authorizing U.S. Immigration and Customs Enforcement (ICE) to delegate to state and local law enforcement officers the authority to perform specified immigration officer functions under the agency’s direction and oversight.

Whereas, the 287(g) Program enhances the safety and security of our nation’s communities by allowing ICE Enforcement and Removal Operations (ERO) to partner with state and local law enforcement agencies to identify and remove incarcerated criminal noncitizens who are amenable to removal from the U.S. before they are released into the community.

Whereas, ICE recognizes the importance of its relationships with its law enforcement partners to carry out its critical mission.

Whereas, the 287(g) program allows ICE — through the delegation of specified immigration officer duties — to enhance collaboration with state and local law enforcement partners to protect the homeland through the arrest and removal of noncitizens who undermine the safety of our nation’s communities and the integrity of U.S. immigration laws.

Whereas, the state of Florida is a border state in the geographical shape of a peninsula surrounded on three sides of intercoastal waterways: on the West coast the Gulf of Mexico, on the East Coast the Atlantic Ocean, and to the South coast by the South Caribbean Sea. 

Whereas, Governor Ron DeSantis is the Governor of Florida announced a newly still forming coalition that to date consists of more than 90 sheriffs from across America who are united in the struggle to keep our communities safe from the ravages of our collapsed southern border. Whereas, so far, more than 45 other sheriffs signed said agreement.
